Development of NH bypass from Kazhakuttom to Karode

 

The National Highways Authority of India (NHAI) has granted approval for a compensation package for acquiring land from Kottukal village for the development of the 43.62-km NH-66 bypass from Kazhakuttom to Karode on the Kerala-Tamil Nadu border.

The NHAI decision comes at a time when the NHAI has invited a Request for Proposal (RFP) for converting a 26-km stretch of the NH-66 bypass from Kazhakuttam to Mukkola into a four-lane road.

The NHAI’s invitation for the RFP was following the delay in handing over land for the 17.62-km stretch of the road up to Karode.

Official sources said the NHAI orders were issued on Thursday on the basis of the report given by the Competent Authority Land Acquisition (CALA).

A sum of Rs.78.60 crore would be given by the NHAI as compensation to the landowners in the Kottukal village.

Official sources said the authority would come out with an approval for the other four villages in the 17.62 km stretch once the CALA submitted the report.

The order issued by the DGM (LA & Coord), NHAI, Prag Ghosh said the compensation rates were indicated by the State on the basis of the sales statistics for similar adjoining land as on the date of publication of the statutory 3A notification on March 22, 2012, and July 13, 2013.

The rates fixed by the NHAI were Rs.8,464/sq m for dry land with PWD road access, Rs.7,618/sq m for dry land with Panchayat road access, Rs.6,671/sq m for dry land without road access, and Rs.5,925/sq m for wet land.

The local project director of the NHAI was also asked to ensure that the land was transferred into the NHAI’s possession and simultaneously mutated in the name of the government after the compensation money was deposited with the CALA.

Tharoor’s intervention

Describing it as an important day for the people, Union Minister of State for Human Resource Development Shashi Tharoor said it would bring relief to the people who were suffering for more than four decades.

With this, Mr. Tharoor said the final step for reaching the actual payments to the beneficiaries had been completed. “After receiving the payments, the land owners could go in appeal for additional compensation under various arbitration processes”, he added.

BOT project

The Public-Private Partnership Appraisal Committee of the Union government has given nod for the first 26 km of the project to be taken up on a public-private partnership mode at a cost of Rs.577.95 crore.

The entire 43.62 km stretch will cost Rs.1,170 crore.

The 43.62-km stretch from Kazhakuttam to Karode is part of the 212-km NH-66 (old NH-47) bypass project of the NHAI from Thuravur that began in 1974. It is part of the National Highway Development Project Phase III.

The 22-km first phase, from Kazhakuttom junction to Kovalam junction, was converted into a two-lane 15 years ago. Land has been acquired for a four-lane stretch and to the extent of 45 metres along the bypass on the Kazhakuttam-Chakka-Eenchakkal-Kovalam stretch.

    I ariya meto from arunachal Pradesh, allover in India we had a highway in many places and our people who lose there own property in that highway project they got compensation in return but we got nothing… I want to know the list of compensation the government of india spended in Arunachal…

    It is submitted , daily some statement is comming from Mr. Nitin Gadkaari from some where else in the country as today again has given the statement from Guhati and he has further discussed and made categorical clear on TV Chanel while debate with Mr. Dig Vijay Singh that compensation in Road projects would be four times of the market value and he has amended the law by removing the word “upto”. It is pertinent to mention that the Schedule one in the new Act RTFC 2013 is the same and there is no change in the formula earlier fixed. It has not been amended even while issue of ordinance and re-issue of ordinance on 3rd April. He should clear the position and get the orders issued from NHAI or other competent authorities to the CALA so that compensation is paid correctly according to the new act. It further needs to be made clear that, where an award has been passed but neither the compensation has been paid nor possession has been taken , the compensation & Solatium should be paid in the new format as per statements and schedule one is amended accordingly to avoid ambiguity before it becomes a law. This is necessary that farmers may not be cheated and are shown the door of the courts un-necessary .

    i am very pursuing very closely the statements, interviews debates of shri nitin gadkari and he has always been very categorical that he and the PM have taken the decision that flat rate compensation will be give for land acquired in rural areas for construction of national highways and not upto 4 times depending upon distance of land from city. When i sought confirmation under RTI from NHAI Head Office New Delhi i was replied that Ministry of Road Transport and Highways, GOI vide letter No 11011/30 2015-LA dt 12.08.2015 that multiplication factor will2 or as specified by the state govt. Thus it is evident that what mr Gadkari has been saying is not correct. He has now lobbed the ball in the court of state govts. Further,the definition of rural area or urban area is neither defined in central act(RFCTLARR Act 2013) or state govts rules made in this regard. NHAI officials are now treating agricultural land outside of municipal limits also as urban land if it falls within semi urban category of circle rate list of district admn for charging stamp duty for registration that is the land outside of municipal area but within the limit of area specified for development in master plan of 2030 of city development authority. It is sheer high handed ness of NHAI and forcing farmers into litigation.

    Kindly refer to the comments on 3rd may 2015. As per the promise of Hon’ble Minister Sh,Gadkari, Rural Dev Ministry has now issued notification on 9-2-2016 for four time compensation for acquisition falling in Rural area only but still decision for urban area is not coming so for as per discussion in the standing committee. Again big ambiguity has arisen due the fact the acquisition may be touching by one inch after rural jurisdiction. Kind attention urban development Ministry on this account. The act is full of ambiguities and controversies, the poor farmers are suppose to go in litigation to get justice of equity for the acquisitions under National Highways act in view of the spirits of the proviso to section 24(2) of the new act and its applicability w.e.f. 1-1-2014 in the circumstances , where an only award has been passed and that is only on papers , No compensation paid /no possession taken as on 1-1-2015. Farmers are humbly requesting time and again to solve this injustice .

    sir, my land and constructed shop on land both are acquired by NHI on 32B nh. i want to rules of NHi from which NHI decieds the owner of building and owner of land. is the both person are differ in rules of NHI.

    Here in Gujarat compensation rate is very migre 45persqmt for wet land in some villages. Farmers wishes more than that. Compensation for structures building is also about 450persqft.

    My land had been aquired by Nh 37in 2008 between Jhanji to Demow.
    Till today not getting àny compansation n pd said fund not come yet.bur GM nahi said all payments disbursed to DC.
    It is confuse matter one is saying no another one asking for papers n after deposing all documents they are silent now what to do.now i? 2017

    My land had been aquired by Nh 58in 2008 between Meerut to Muzzeffer Nagar.
    Till today not getting àny compansation n pd said fund not come yet.bur GM nahi said all payments disbursed to DC.
    It is confuse matter one is saying no another one asking for papers n after deposing all documents they are silent now what to do.
    Please help

    Sir,

    Notice served by Competent Authority, ADM for land Acquisition for widening of NH-29 on 11.08.2016 and file submitted by us on 29.08.2017 by registered post but we didn’t get compensation yet after passing one year however nearby landowners got their compensation. NHAI have tried to take Possession in our land but stopped by us.

    In above respect I want to know that Is there any provison in laws or judgement given by court that if Competent Authority/NHAI is delaying in land compensation then interest over compensation amount will be given to land owners.

    If yes please specify the law and rate of interest also .

    Sir,
    My land n building has been aquired by Nh 37 4laning purpose n award has been fixed in 2015, but not paid till today.After many request to local revenue dept they agreed to pay amt. In between they paid to all my nearby. Suddenly they imposed re assessment n in may 2017 n again delay tactics apply by local authority.Now I want to know is it possible for re assessment for only rest few pending, no of files to make payment is only 13.

    My House building on the site of NH31D. 4 Decimal land acquired by NHAi. I have House Building on that land and only 10 feet of the house building has fallen on that acquired land rest 50 ft house building out side the acquired land. Whether I will get full value of my house building. What is the lAW of NHAI in this regard.

    To The NHAI, I have only two Acr land at gut no 118 Tissgaon and authority acquiring 17 guntha land is not a problem if pay the rate of today’s registry rate but NHAI occupying land under prohibited area is without compensation which is illegal as you are acquiring two acr land in a cost of 17 guntha and I m loosing totally two acr land because land remain very small strip which I can’t do any construction. I request compensation to be made for land under prohibited area too.

    Sir, i am the resident of kapagunneri village, sri kalahasti mandal, chittoor district
    Andhra Pradesh state. i am loosing my land 3156 sqmts under NHAI 4 LANE EXPANSION .NH71 Renigunta to poiyee. please inform me sir what will be the
    compensation can get for this land. what act will be applicable for this acquisition.
    open market presently the value is Rs 1.5 crores per Acre. i am having only .88 Acres in this almost .78 acres loosing. if not paid compensation in the right mannar.
    please inform us how to fight for the right compensiation

    Sir,
    I have a NA land for an extent of 3.25 Acres Out of which 2.29 acres of land has been acquired by NHAI for the purpose of Construction of Toll Plaza. In this regard , the access to apporach the balance land was denied by the NHAI Authorities. We have requested the authorities either to give access to the land or acquire the balance land . but there is no reply from them . Kindly suggest me what is to be done.
